Section 45 Swimming Pools
Section 45.   Swimming Pools.

Each swimming pool, whether "public" or "private" as defined at Section 422.2 of the Commonwealth of Massachusetts State Building Code, shall be enclosed by a fence not less than four (4) feet (48") in height, which shall completely enclose the swimming pool and surrounding walks and diving platforms. Each fence must have a gate that shall be locked when such pool is not being used or is unattended. The latching device shall be located a minimum of three (3) feet from grade level, and a locking device attached thereto.

Fencing for above ground pools with side walls of four (4) feet or more shall be deemed to be complied with if there is a ladder that may be raised, removed, secured, hoisted, or locked in a raised position. Pools with side walls less than four (4) feet must be fenced according to the above.

Each fence and gate shall be constructed either of wire mesh, wood, or concrete blocks. Posts and cross pieces of any fence shall be placed on the inside or pool side of said fences. Mesh or openings in fence shall be no larger than two inches wide and four inches high (2" x 4"). All metal fences, enclosures, or railings to which bathers have access near or adjacent to a swimming pool, and which may become electrically alive as a result of contact with broken overhead conductors, or from any other cause, shall be effectively grounded. All lighting and electrical equipment shall be installed according to the National and State Electrical Codes, and shall comply to local inspection and permit requirements.
